RGS Cleaning Ltd
the Customer has requested the Contractor to supply and the Contractor has agreed to supply the Services described in Schedule 1 hereto (“the Services”) at the premises described in Schedule 2 hereto (“the Premises”) and the parties have agreed that any Services supplied shall be in accordance with the following terms.
Permitting RGS to begin service shall act as acceptance of these terms and conditions.
(a) The Contractor shall perform the Services with due diligence and care. (b) The Contractor shall ensure so far as is practicable that its employees are efficient, conscientious and diligent. (c) The Contractor shall perform the Services causing as little disruption as practicable to the Company’s business. (d) The contractors responsibility for matters of Health Safety will be met during the contracted hours only and that all alleged third party Incidents after the cleaning time are not the responsibility of the Contractor. Any problems that arise with connection to the floor surfaces or matters of health and safety must be reported to the contractor, prior to further work commencing.
a) The Contractor shall ensure that its employees observe the reasonable instructions of the Contractor from time to time. b) The customer is requested to refrain from giving instructions to staff directly and that any such instructions should be directed to the contract supervisor/manager. That other than simple information or information in relation to immediate risks to health and safety, at all times be directed to the contract supervisor/manager.
a) Where included in the quote, the Contractor agrees to provide the prescribed cleaning equipment plus that required to undertake the tasks and service as per the specification. b) The contractor will ensure said equipment is regularly tested and maintained in good working order. c) Where the customer is providing equipment and materials, they will ensure full training, COSHH, risk assessments, PAT testing of equipment etc. is undertaken and where required, provided to staff.
a) The Customer shall pay to the Contractor throughout the continuation of this agreement the sum as stated on the accepted quotation of service to be invoiced on completion of work done, payable by the due date on the invoice issued or as agreed in writing with a maximum credit term of 30 days from the date of invoice.
b) All our staff receive 5.6 weeks holiday pay pro-rata. All credits will be issued at the cleaner wage rate as all other costs are separate to this.
c) All sums payable under this Agreement unless otherwise stated are exclusive of Value Added Tax.
d) Any Value Added Tax payable in respect of such sums shall be payable by the Customer in addition to such sums on the dates specified for payment in sub-clause (a) hereof.
e) If the Fees shall at any time be unpaid after the date stated on the invoice for payment hereunder, the Contractor may (without prejudice to any other rights hereunder) immediately terminate or suspend this Agreement and service and begin charging interest at 8%.
f) Claims for shortfalls must be made within 3 days from the date of invoice.
RGS Cleaning Ltd will ensure Minimum Wage regulations are observed
a) The Customer shall allow the Contractor access to the Premises to enable the Contractor to perform the Services. b) The Customer shall be responsible for ensuring the safety of the Premises for the employees of the Contractor and shall ensure that the Contractor’s employees are given instructions relating to emergency and security procedures. c) Where the Contractor is supplying equipment and materials, will insure that all equipment complies with current legislation with regard to C.O.S.H.H. and will provide all health & safety documentation as required by law OR The Customer will will insure that all equipment complies with current legislation with regard to C.O.S.H.H. and will provide all health & safety documentation as required by law where the contractor is supplying equipment and materials. d) Risk assessments will be undertaken where necessary and can be found at https://office.rgscleaningltd.co.uk/downloads
e) The customer will ensure access is provided as agreed and where access has been arranged though there is a delay in works starting where the contractor has arranged on time, the contractors arrival time will be the point at when any agreement is seen to have commencement in relation to any time agreed for works.
a) The Customer will not approach any contractors staff working on site, to engage in other works other than those delivered by the contractor at the time. Additional works must be agreed in writing with the office. b) the customer agrees not to solicit works or offer employment to any of the contractos staff at any time unless requesting additional works through the head office.
a) RGS Cleaning Ltd reserves the right to inform/involve the police should there be any instances of theft, or other such acts of misconduct, where the cleaners employed by the company are accused or suspected to be responsible. b) RGS Cleaning Ltd will not undertake any search or investigation where an accusation of theft has taken place, employee information will be given to the customer to liaze with the local police force to undertake any investigation when requested by the police under GDPR regulations.
